“These Terms and Conditions establish the rules and regulations governing the utilization of the website https://eazycourses.com/ (referred to as the “Site”). It encompass all aspects of the Site, Application, and any associated elements like features, subdomains, content (excluding specified cases), functionalities, products, services (which include the Services), media, applications, or solutions provided on or through the Site and/or the Application and/or via various methods, mediums, platforms, or formats. This includes distribution through Secure Digital (‘SD’) cards, tablets, or any other storage/transmission devices. Collectively, all of these are referred to as the “Platform” or “EazyCourses Platform”.”

“These Terms and Conditions are relevant to all users of the Platform, encompassing but not restricted to individuals who generate and/or present Content Provider Content (as described in the ‘Intellectual Property’ section below) on the Platform (referred to as “Content Providers”), as well as users who use the Platform to gain knowledge in a subject or skill (referred to as “Learners”), or users who access the Platform in other capacities (collectively addressed as “you,” “your,” or “Users”). These Terms and Conditions, in conjunction with the Privacy Policy, Refund Policy, Cookies Policy, Accessibility Statement, the User Guidelines, and any other conditions, regulations, policies, or guidelines incorporated in these Terms and Conditions or the Privacy Policy by reference and/or as updated on the Platform, or otherwise communicated to you occasionally (including terms from other third-party platforms that might be used or accessed to gain entry to the Platform or employ the Services on the Platform, collectively referred to as the “Platform Terms”), establish the connection between you and EazyCourses. They will oversee your use of the Platform and the Services (defined below) provided therein. Your entrance to the Platform is dependent on your acceptance of the Platform Terms. This acceptance establishes a legally binding agreement between you and EazyCourses (“Agreement”). Thus, we urge you to allocate sufficient time to fully comprehend the Platform Terms.”

“Periodically, updated versions of the Platform Terms may be accessible as mentioned above for your consultation. By accessing and using the Platform, sharing your Personal Information (as defined in the Privacy Policy), utilizing the provided Services, or otherwise indicating your agreement when prompted, you explicitly acknowledge and consent to the Platform Terms. If you disagree with any of the terms or choose not to be bound by them, we ask that you refrain from using the Platform in any capacity.

When we mention “EazyCourses,” “we,” “us,” and “our,” we are collectively referring to GI Facility Services – a registered Proprietory Firm in MSME Indian entity and all of its authorized affiliates responsible for hosting the Platform and providing Services. To determine which specific EazyCourses entity your Agreement pertains to, please consult the ‘About EazyCourses and the Platform’ section within these Terms and Conditions.

All words capitalized in these Terms and Conditions are defined or carry the significance ascribed to them within this document. In simpler terms, if you encounter any capitalized word herein, it implies that we have clarified its interpretation within the context of these Terms and Conditions and/or the Platform Terms. If not found here, you will locate the definition in the applicable Platform Terms. Whenever we reference such a term in these Terms and Conditions, we endeavor to indicate where you can locate its definition within the Platform Terms.”

1. “Insights into EazyCourses and the Platform”

“In India, the ownership, management, operation, and provision of the Platform are undertaken by GI Facility Services, a sole proprietorship firm registered with MSME India. The registered office is situated at 3rd Floor IT Park, Mantripukhri, Imphal East – 795002, Manipur, India. (“EazyCourses”). In any jurisdiction beyond India, where Services are made available through the Platform, they are provided by EazyCourses and/or its pertinent affiliates, as determined by suitable intra-group contractual arrangements. To ascertain the specific EazyCourses entity with which your Agreement will be established, please consult the list provided in Annexure A below.”

2.Services on the Platform

EazyCourses Platform functions as an online service hub that empowers Content Providers to craft and offer content in diverse forms, such as videos, audios, written materials, both pre-recorded and live, across a wide array of categories. This content, generated by Content Providers, is then made accessible to Learners. EazyCourses serves as an intermediary between Content Providers and Learners, in accordance with legal frameworks like the Information Technology Act, 2000, or the Digital Millennium Copyright Act. EazyCourses delivers Content Provider Content to Learners, which includes subscription-based options. Additionally, EazyCourses might provide supplementary services like question databases, practice exams, solving doubts, live mentoring, live streams, competitions, scholarships, webinars, and physical or virtual events. It also facilitates discussion platforms.

Moreover, EazyCourses could offer certain products/services in collaboration with various platforms within the EazyCourses Group (defined in the Privacy Policy). In such instances, if these products/services are accessed via the Platform, the terms specified for the Platform will remain applicable.

Within the context of the Platform Terms, the terms “Services on the Platform ” or “Services” encompass all the services detailed in this section, along with any other products or services provided by EazyCourses.

By utilizing the Platform, you understand and accept that EazyCourses bears no control over and assumes no liability for User-generated Content (as defined in the ‘Intellectual Property’ section below). Consequently, your use of the Platform releases EazyCourses from any responsibility linked to User-generated Content.

You also acknowledge and agree that EazyCourses holds the right to modify or terminate any Service, product, aspect, or feature on the Platform, including User-generated Content (within the confines of being an ‘intermediary’), its availability, and the compatible devices necessary for accessing the Services. EazyCourses retains the authority to terminate your Subscription and/or restrict your Platform access if you opt not to furnish, or partially furnish, requested information.”

3.Access Privileges and Account Setup

As a learner, in order to gain access to the Platform and utilize specific Services, it will be necessary for you to go through the registration process and establish an account on the Platform by furnishing the necessary information.

To create an account on the EazyCourses Platform, you must adhere to the stipulated ‘Age Requirements’ as outlined below. By engaging with the EazyCourses Platform, your actions serve as confirmation that you meet these Age Requirements.

You have the option to register on the Platform without incurring any charges; however, there might be fees associated with certain Services provided on the Platform. Kindly review the Service offerings presented on our Site or Application(s). It’s important to note that you are under no obligation to make any purchases or use any Services featured on the Platform.

4.Age Eligibility for Platform Registration and Usage (“Age Requirements”):

If you are a citizen of India or any other nation (excluding the USA, UK, or EU nations), you must have reached a minimum age of 18 (eighteen) years to register and utilize the EazyCourses Platform.

For individuals residing in a European Union (EU) country who have achieved a minimum age of 16 (sixteen) years, registration and use of the EazyCourses     Platform are permissible.

Residents of the United States of America (USA) or the United Kingdom (UK) who have reached at least 13 (thirteen) years of age are eligible to register and make use of the EazyCourses Platform.

In cases where you are a resident of the USA, UK, or EU countries and fall within the age range of 13 to 18/16 to 18 respectively, or if you reside in any other country and are considered to be of an age appropriate for internet services but fall below the contractual age stipulated by the applicable laws of   that country, your utilization of the Platform affirms that your Parent(s) (as defined below) have granted permission for your use of the Platform. Your Parent has also read, agreed to, and accepted the Agreement. In situations where disputes arise between you and EazyCourses based on your Agreement with us, the terms specified within our Agreement will be applicable and enforceable against your Parent.

A Learner who doesn’t satisfy the aforementioned Age Requirements (which may be revised according to applicable laws) and wishes to register on the Platform, in the case where the Learner is a “Minor” or “Child,” can utilize the Platform only with the permission and under the guidance of their parent or legal guardian (“Parent”). Therefore, in such instances, the Parent must consent to the Platform Terms during their own registration on the Platform. It’s important to note that Minors or Children are not eligible to register on the Platform independently. When a Minor or Child engages with the Platform, we assume that the Parent of that Minor or Child has authorized the Minor or Child’s utilization of the Platform by agreeing to the Platform Terms and that such usage is supervised by the Parent.

EazyCourses retains the right to terminate your Subscription and/or limit your access to the Platform if it is discovered that you fail to meet the Age Requirements and/or haven’t obtained the necessary consent to register and use the Platform as outlined above. You acknowledge that EazyCourses isn’t responsible for verifying your compliance with the mentioned Age Requirements. It’s your sole responsibility to ensure that the requisite criteria are met.

For those acting as Content Providers, accessing and using the Platform might also be subject to separate agreement(s) with EazyCourses. These agreements will collectively be governed by the terms of such agreements, the Terms and Conditions, other Platform Terms, and any other terms communicated or agreed upon with the Content Provider periodically.

Furthermore, the authorization granted by EazyCourses for accessing and using the Platform in accordance with these specified Terms and Conditions is contingent upon adhering to the following stipulations:

a. You agree not to disseminate any portion of the Platform, Content Provider Content, or EazyCourses Content (as defined below) through any medium without obtaining prior written authorization from EazyCourses.

b. You agree not to make any alterations or modifications to any segment of the Platform.

c. You agree not to access User-generated Content of other Users through any means except those legitimately accessible to you.

d. You agree not to engage in the following commercial activities on the Platform unless you have obtained prior written consent from EazyCourses:

e. Placing advertisements, sponsorships, or promotions on or within the Platform or Content Provider Content.

f. Advertising, endorsing, or promoting any third-party webpage or website.

g. Selling access to the Platform.

h. You consent to receiving installations and updates periodically from EazyCourses. These updates are intended to enhance and improve the Platform, potentially encompassing bug fixes, upgraded functionalities, new software components, and entirely new versions. You acknowledge and allow EazyCourses to provide these updates as part of your Platform usage.

i. You undertake not to employ or initiate any automated system, including but not limited to “robots,” “spiders,” or “offline readers,” to access the Platform in a manner that generates more request messages to EazyCourses’s servers in a specific time frame than a human could reasonably generate within the same duration using a conventional online web browser. Nonetheless, EazyCourses grants public search engine operators the right to use spiders to copy materials from the Site exclusively for the purpose of creating publicly accessible searchable indices of the materials. This permission does not encompass caching or archiving of such materials. EazyCourses maintains the prerogative to revoke these exceptions, either on a general basis or in specific instances, at any  time, with or without prior notification. You concur not to collect or gather personally identifiable information, including account names, from the Platform, and you also agree not to use the communication systems provided by the Platform, unless stated otherwise herein.

j. You have the liberty to post reviews, comments, and other content, as well as to transmit additional communications and submit suggestions, ideas, questions, or other information, as long as the content is lawful, non-obscene, non-threatening, non-defamatory, non-invasive of privacy, non-infringing on intellectual property rights, and does not cause harm to third parties or elicit objection. This content should also refrain from containing software viruses, political solicitations, commercial appeals, chain letters, mass emails, or any form of spam. In essence, your conduct on the Platform must adhere to the Platform Terms, including the User Guidelines.

k. In your utilization of the Platform, you are obligated to abide by all relevant laws and regulations at all times.

l. EazyCourses retains the right to discontinue any aspect of the Platform at its sole discretion, either with or without notice, at any given time.

It is your responsibility to maintain the confidentiality of your account and password used to access the Platform. You acknowledge that your account is intended solely for your personal use, and you agree not to grant access to the Platform to any other individual. You should also take precautions to secure your device to prevent unauthorized entry into your account. You assume full responsibility for all activities conducted under your account. Be cautious when accessing your account from a public or shared computer to prevent others from observing or recording your username, password, or other Personal Information. It’s crucial to keep your password confidential and secure at all times. If you suspect that your password has become known to someone else or is being used without authorization, promptly change your password or inform us of any unauthorized access to your username or password. This allows us to assist you in halting or preventing such unauthorized usage. It’s essential to ensure that the information you provide to us is accurate and complete.

You affirm that the information you provide during registration is accurate, truthful, and correct. You also commit to updating this information whenever any changes occur. To understand how we manage your information, please review our Privacy Policy.

Please be aware that we retain the right to decline or temporarily suspend your registration on the Platform as needed to comply with legal and regulatory requirements. We also hold the authority to deny access to the Platform, terminate accounts, eliminate content without prior notification, and/or deactivate any account, feature, or identifiers, whether chosen by you or assigned by us, if we determine that such identifiers or you have violated any clauses of the Platform Terms.

Moreover, in order to gain entry to the Platform, and to generate, publish, or view User-generated Content on the Platform, it is necessary to employ a “Supported/Compatible Device.” This pertains to a personal computer, mobile phone, portable media player, or any electronic device that conforms to the prescribed system and compatibility prerequisites and on which you possess the authorization to utilize the Platform. The roster of Supported/Compatible Devices for accessing the Platform and/or accessing the Services might undergo modifications over time. Additionally, the designation of a device as a Supported/Compatible Device may hinge on software or systems supplied or upheld by the device manufacturer or other third-party entities. Consequently, devices that currently qualify as Supported/Compatible Devices might not retain that status in the future. It is, therefore, advised to ensure that the device you utilize aligns with our system/software requirements to ensure seamless usage of the Platform and to access the Services offered therein.

5. Terms of Subscription

For Learners, there is no fee imposed by EazyCourses for the process of registration and the establishment of an account. However, specific Services provided by EazyCourses might involve charges. Consequently, EazyCourses offers access to certain Services and features through a multi-tiered paid subscription plan(s) or direct purchases. The comprehensive information detailing the Services, associated features, and their corresponding prices can be located on our Site and/or Application (“Subscription” or “Subscription Service”). Subscriptions can be acquired by following the guidelines presented during your navigation of the Platform.

The following conditions pertain to your purchase of Subscription(s):

a. Acquiring a Subscription grants access solely to content within the category corresponding to the purchased Subscription.

b. The Services extended and the duration of your Subscription (“Subscription Period”) may differ based on the plan chosen. Consequently, before proceeding with any Subscription purchase, it is advisable to thoroughly comprehend the specifics of the intended Subscription(s) on the Platform. If any aspect of the Subscription offering remains unclear or requires further clarification, you are encouraged to contact us via the email address provided in the ‘Contact for User Support/Queries’ section below.

c. We strive to customize Services, including providing recommendations on subscribed content and other related categories of potential interest. Ongoing enhancements are pursued to elevate the Subscription offerings and enhance your Platform experience.

d. Subscription Periods can be extended upon the renewal of your pre-existing Subscription. Renewal terms, if applicable, can be located on our Site and/or Application. However, it’s essential to acknowledge that prices might be revised from your initial Subscription purchase time.

e. The Subscription is exclusively intended for personal use and benefits only the subscriber. Reselling, transferring, or sharing the Subscription with    others for monetary gain or any other purpose is strictly prohibited. If it comes to our attention that a User has engaged in such actions, EazyCourses    reserves the right to promptly terminate the Subscription.

f. Due to potential constraints imposed by Content Providers (the proprietors of Content Provider Content), the content available under any Subscription    offering may be subject to viewing limitations and restricted availability periods. Such restrictions may evolve as we introduce new features, devices, and content to our Subscription Service. To provide clarity, here are examples of applicable restrictions to your content access (through Subscription Service or otherwise):

g. Live Streaming of Content Provider Content/Live Videos: Access to attend live videos (i.e., live-streamed content) is granted if included in your purchased Subscription. This access is available on the Platform during your Subscription Period and is governed by the Platform Terms, including Live Videos Terms and Conditions. Be sure to use a Supported/Compatible device (refer to the ‘Right to Access and Account Creation’ section above) while accessing live videos.

h. Viewing Period: Depending on your Subscription, recorded versions of relevant live videos may be accessible for continued viewing on the Platform    (which may include in-app downloading as mentioned below) during your Subscription Period. Please note that availability of these recorded versions  for subsequent access on the Platform is contingent upon our agreements with Content Providers and is not guaranteed for any reason.

i. Streaming Quality: The resolution and quality of content depend on factors like the type of Compatible Device used and your bandwidth. Although we aim for a high-quality viewing experience, we cannot assure the resolution or quality of streamed content.

Depending on the Subscription Service, access to certain additional Services and features may be provided. Specific terms related to these additional Services will be accessible on the Platform, either in the form of terms and conditions or Frequently Asked Questions (FAQs) for the respective Service. It’s recommended to review the Platform Terms to understand any additional services made available and how to access them.

6. Payments, Refunds and Pricing

To acquire a Subscription Service for specific content categories of your choice, you can follow the provided instructions on the Platform and complete the relevant payment for the desired Subscription.

Kindly review the subsequent terms applicable to the purchase of your Platform Subscription. These terms are intended to be considered alongside any other terms conveyed to you during the Subscription purchase:

You acknowledge your responsibility to settle all Subscription fees and charges associated with your Platform account. Solely you are accountable for the payment of these fees and charges. Subscriptions must be paid in full and in advance, remaining valid until the culmination of the designated Subscription Period or until terminated as per the stipulations within this Agreement.

If you have explicitly granted us authorization, payments for applicable Subscriptions will be automatically processed at the beginning of each billing cycle. This will occur unless you revoke your authorization or submit a cancellation request directly through your account before the billing period commences, or in writing via email to the address specified in the ‘Contact for User Support/Queries’ section below. If your Subscription payments span multiple installments, payment will be charged on the anniversary of the billing period. Authorization is conditional, and EazyCourses may debit the credit card, debit card, or linked account initially used for Subscription purchase or updated by you through your Platform account, provided the update is completed before the upcoming billing period.

If Subscription payments remain incomplete, access to the Platform may be restricted or suspended until your account is brought up to date through full payment.

We retain the right to recover outstanding fees using methods that may encompass charging alternative payment methods on record and/or engaging collection agencies or legal representation.

Your payments will be allocated within the EazyCourses group according to Annexure 1.

Payments to EazyCourses are subject to applicable taxes, including Goods and Service Taxes (GST), Value Added Taxes (VAT), or similar taxes in your country of residence or the location where you created your Platform account or purchased the underlying Subscriptions.

We retain the right to modify or revise Subscription pricing. For existing Subscriptions with already received fees, price adjustments will be implemented during the subsequent billing cycle or renewal of the Subscription.

Furthermore, we hold the prerogative to provide custom plans and pricing (inclusive of discounts and/or special offers) beyond what is publicly available on the Platform. This may involve tailored billing and payment terms distinct from our standard provisions.

Third-party payment gateways and aggregators are employed to process applicable payments for our Services. The availability of third-party payment gateway(s) can vary based on the chosen Subscription. We’ve also integrated third-party payment providers to offer improved payment options, subject to territorial considerations and the chosen Subscription. The collective term “Third-Party Service Providers” encompasses both third-party payment gateways/aggregators and third-party payment providers.

These Third-Party Service Providers may levy fees for service usage and may require your Personal Information to execute transactions on the Platform. In facilitating payments to us via the Platform or utilizing available payment options, you may be redirected to an external website operated by a Third-Party Service Provider. We neither guarantee the adequacy of privacy and security practices employed by these providers nor control the collection or utilization of your Personal Information. It is advisable to review the terms, conditions, privacy policies, and other relevant policies of Third-Party Service Providers before using their services. EazyCourses and Third-Party Service Providers are not affiliated, nor are they agents or employees of each other.

Depending on your chosen payment option, a separate agreement with the relevant Third-Party Service Provider may be required. This agreement is an independent contract between you and the Third-Party Service Provider, in which EazyCourses is not a party. EazyCourses facilitates various payment options and does not independently offer payment services.

You acknowledge sole accountability for charges incurred through Third-Party Service Providers. Additionally, you agree to indemnify, defend, and hold EazyCourses and its affiliates harmless from any loss arising due to Platform usage or purchases through the Platform. This obligation endures beyond your use of the Platform and the termination of our Agreement. In the context of these Platform Terms, “Loss” encompasses losses, liabilities, damages, awards, settlements, claims, suits, proceedings, costs, and expenses, including legal fees and disbursements, investigative costs, litigation, settlement, judgment, interest, and penalties. EazyCourses bears no liability for claims resulting from acts or omissions of Third-Party Service Providers, including issues such as lost, stolen, or improperly processed payments. Our disclaimer extends to services provided by Third-Party Service Providers.

It’s important to note that all Subscription payments are collected solely by EazyCourses through the Platform, excluding Third-Party Service Providers. Generally, we do not authorize third parties (excluding Third-Party Service Providers) to collect payments on our behalf. If any third-party collection has been authorized by EazyCourses, written confirmation is provided through agreements or authorization letters. Prior to making payments to any third party, verify their status, or consult EazyCourses by contacting us via the email address listed in the ‘Contact for User Support/Queries’ section below.

EazyCourses is exclusively empowered to offer discounts/offers on Subscription prices. These discounts/offers are conveyed via the Platform or communicated directly by EazyCourses through email, SMS, phone, or other channels. They can only be availed through the Platform, unless communicated otherwise by EazyCourses. Aside from EazyCourses, no party, including Content Providers or any third-party platform, is authorized to provide discounts on Platform Subscription prices. EazyCourses is not liable for claims arising from unauthorized discounts/offers provided by any entity other than EazyCourses.

Cancellation and Refund Policy:

You have the option to cancel your Subscription via your Platform account. However, note that cancellation becomes effective at the conclusion of the ongoing billing period. In other words, your Subscription will not be renewed, but the existing Subscription remains active until the end of the billing period. No refunds for fees already paid will be provided unless explicitly outlined in the Refund Policy. Therefore, prior to purchasing any Subscription, we advise you to carefully review these terms and conditions, along with the Refund Policy.

Upon cancellation, EazyCourses may deactivate access to features obtained through your Subscription purchase, while your Platform account may persist.

7. Platform Usage:

In alignment with the Platform Terms, EazyCourses hereby grants you a limited license that is non-exclusive, non-transferable, non-sublicensable, and subject to certain restrictions. This license enables you to access and utilize the EazyCourses Platform for your personal, non-commercial, and private purposes. This access is provided on an “as is” basis, adhering to these Terms and Conditions and other pertinent Platform Terms.

Further, contingent upon payment of the Subscription fee and your adherence (as a Learner) to all Platform Terms, EazyCourses, along with Content Providers, extends a non-exclusive, non-transferable, non-sublicensable, and limited license to you (as a Learner). This license, valid during the relevant Subscription Period, grants you the ability to access and view the subscribed content and partake in live videos linked to your Subscription. This permission is granted exclusively for personal, non-commercial, and private utilization, governed by the Platform Terms. Access to content on your Compatible Device may be automatically rescinded upon the Subscription Period’s conclusion or in accordance with specified limitations in the Platform Terms.

For Content Providers, EazyCourses offers a limited, non-exclusive, non-transferable, and non-sublicensable license. This license permits access and usage of the Platform for your personal and commercial purposes, aligning with these Platform Terms and any other agreements established between you (as a Content Provider) and EazyCourses (where applicable). Unless specifically authorized by EazyCourses through these Platform Terms or written correspondence, you are prohibited from reproducing, copying, selling, redistributing, creating derivative works, or otherwise exploiting the Platform or its components, including copyrighted materials, trademarks, and other proprietary information.

Except as explicitly allowed under any of the Platform Terms or in writing, any reproduction, duplication, copying, sale, redistribution, creation of derivative works, or other forms of exploitation of the Platform or its components (including copyrighted materials, trademarks, and proprietary information) are strictly prohibited.

8. Content and User Conduct:

As a User, you have the ability to contribute User-generated Content (as defined in the ‘Intellectual Property’ section below) to the Platform. Nevertheless, it is important to note that EazyCourses cannot guarantee the confidentiality of any User-generated Content you submit.

You hold sole responsibility for your own User-generated Content and the implications of publishing such content on the Platform. By submitting User-generated Content, you affirm, represent, and warrant that you possess the necessary licenses, rights, permissions, and consents to publish the said content. You also agree that the User-generated Content you submit does not incorporate copyrighted material owned by third parties, or material subject to third-party proprietary rights, unless you have obtained permission from the rightful owner of the material or are legally entitled to post the content and grant EazyCourses the essential licenses and rights as per the Platform Terms. You bear full responsibility for any claims arising from your published User-generated Content on the Platform.

To clarify, you retain ownership rights over your User-generated Content. However, you grant EazyCourses a limited license to make your User-generated Content available on the Platform. Detailed information about the nature of the license and the rights you grant to EazyCourses can be found in the ‘Intellectual Property’ section below.

Furthermore, you acknowledge that you shall not upload, display, host, publish, transmit, modify, share, update, or store any User-generated Content or information on the Platform that:

a. Belongs to someone else and to which you lack the right. Is defamatory, obscene, pornographic, invasive of privacy, insulting, harassing based on gender, libelous, racially or ethnically objectionable, incites money laundering or gambling, or is contrary to prevailing laws.

b. Is harmful to minors.

c. Infringes upon another’s patent, trademark, copyright, or other proprietary rights.

d. Violates laws, statutes, ordinances, regulations, or Platform Terms.

e. Misleads recipients about the origin of the message or intentionally conveys false information.

f. Impersonates another individual.

g. Threatens national unity, integrity, security, or sovereignty, or incites offenses.

h. Contains malicious software or computer code aimed at disrupting or limiting computer functionality.

i. Contains false or misleading information written with the intent to deceive or harm.

j. Is obscene or contains explicit content.

k. Contains viruses, trojans, worms, or other programming routines that may damage or intercept systems or data.

Your behavior on the Platform must align with the User Guidelines and other relevant Platform Terms.

You acknowledge that during your use of the EazyCourses Platform, you shall not post content, comments, or engage in any behavior amounting to harassment of other Users. In case EazyCourses becomes aware of your harassment towards other Users, EazyCourses reserves the right to suspend/terminate your account without notice and potentially initiate legal proceedings.

EazyCourses does not endorse User-generated Content submitted by Users, nor the opinions, recommendations, or advice expressed therein. EazyCourses disclaims any liability concerning User-generated Content. EazyCourses does not tolerate copyright infringement or intellectual property rights violation on the Platform. EazyCourses will remove User-generated Content if properly notified that it infringes on another’s intellectual property rights in line with its role as an ‘intermediary.’ EazyCourses can remove User-generated Content without prior notice if it is deemed violative of these Terms and Conditions. More details about notifying EazyCourses of infringing content and the takedown process can be found in the Takedown Policy and ‘Copyright, Trademarks, and other Intellectual Property Rights’ section below.

You shall not partake in activities that artificially inflate User views on any specific Content Provider, such as creating multiple fake Learner accounts by yourself or through a third-party.

Engaging in activities detrimental to EazyCourses and/or other Users, including screen-recording, screen-casting, or downloading Content Provider Content (live or recorded) in unauthorized ways and sharing or publishing such content on third-party platforms, is strictly prohibited. If EazyCourses becomes aware of such activities, it retains the right to immediately terminate your access/Subscription, remove downloaded content, and initiate legal action, as deemed fit.

9.Communications

When you access the Platform, you engage in electronic communication with us. During the creation of an account or the enrollment/purchase of a Subscription Service, a valid phone number might be required from you. We may communicate with you via email, SMS, phone calls, WhatsApp, or other means. By providing your information, you authorize EazyCourses, its affiliates, and their employees, agents, and contractors to initiate electronic communications regarding your use of the Platform and the products/services offered by EazyCourses and its affiliates. Even if your phone number is on a state or federal do-not-call list, these communications may be made by or on behalf of EazyCourses. Recorded telephone conversations are possible. Please note that your telephone operator and/or internet service provider might apply charges for communications with EazyCourses, and you are responsible for these charges. If you disagree with being contacted by telephone, text, email, WhatsApp, or other methods of communication, please do not submit your information. You can also choose to unsubscribe/opt out of promotional communications by following instructions provided via text, email, or other modes of communication or by using the options within your Platform account.

Keep in mind that:

1. Opting out of promotional communications won’t affect transactional communications like service announcements, administrative notices, and legal information, which we may still send without an opt-out option.
2. If you wish to cease using our Platform or receiving communications from us (except those legally required), you can delete your account by contacting us via email at the address provided in the ‘Contact for User Support/Queries’ section or using the account options.
3. Opting out of promotional communications only applies to future messages from us. If your information has already been shared with a third party based on our Privacy Policy, you may need to update preferences directly with that third party.
4. We do not sell your Personal Information to third parties.

Additionally, concerning interactions between Users: EazyCourses serves as an intermediary and does not actively monitor User interactions on the Platform. However, EazyCourses has established clear conduct guidelines for Users in the Platform Terms. If EazyCourses receives complaints of misconduct against you or deems it necessary for any reason, it reserves the right to suspend or terminate your Platform access, either fully or partially, with or without notice or explanation.

You understand that any User-generated Content (including Content Provider Content, chats, postings, or materials contributed by Users) you post on the Platform is neither endorsed nor controlled by us. You acknowledge that you are solely responsible for any User-generated Content you publish on the Platform, including its legality, reliability, accuracy, and appropriateness. You are accountable for the consequences of its publication. By posting User-generated Content on the Platform, you affirm that you either own the rights to it or possess the required licenses, permissions, or legal entitlements to use and reproduce the content on the Platform.

10. Handling of Personal Information

All the procedures for collecting, processing, sharing, and storing any Personal Information obtained from you adhere to our Privacy Policy. We encourage you to review this policy to comprehend the security measures that EazyCourses implements to protect your Personal Information. 11.Intellectual Property and User-generated Content License

User-generated Content: You retain full ownership of any content you upload, publish, submit, or post on the Platform. This includes content you publish as a Content Provider and any text, images, media, written statements, or other content posted by Users across the Platform, including comments (“User-generated Content”). EazyCourses does not assert ownership over any User-generated Content shared by Users on the Platform.

By submitting User-generated Content on the Platform, you grant EazyCourses a limited, global, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, share, display, publish, store, make available online, and/or electronically transmit the User-generated Content, as well as any technical data collected through the Platform. This license is granted to the extent necessary for various purposes, including but not limited to:

1. Providing the Platform and Services;
2. Fulfilling our obligations under the Platform Terms and other agreements with Users;
3. Maintaining, enhancing, and refining the Platform and related Services;
4. Promoting and disseminating parts or the entirety of the EazyCourses Platform through various media formats and channels;
5. De-identifying User data to eliminate any potential identification;
6. Aggregating User data with other information; and
7. Complying with applicable laws. It’s important to note that aggregated or de-identified information will never be disclosed in a manner that could identify you as an individual. All data processing adheres to our Privacy Policy.

You also grant each Platform User a limited, non-exclusive license to access your User-generated Content via the Platform.

EazyCourses Content: Information and materials (in any form or media) provided by EazyCourses or its affiliates belong to EazyCourses, including but not limited to the Platform, illustrations, images, ideas, designs, layout, logos, trademarks, graphics, audio and video files, software (owned by or licensed to EazyCourses), source and object code, and other data made accessible by EazyCourses (“EazyCourses Content”). This excludes content uploaded by Users, including User-generated Content. You agree not to use, modify, or alter EazyCourses Content in any manner. You acknowledge that your use of the Platform and EazyCourses Content does not grant you ownership or rights to them. EazyCourses Content is safeguarded by copyright, trademark, patent, trade secret, and other intellectual property laws. Unauthorized use, reproduction, modification, distribution, transmission, display, or performance of EazyCourses Content, or any part thereof, is strictly prohibited.

You affirm not to employ data mining tools, robots, or similar techniques to extract significant portions of the Platform for reuse without EazyCourses’s explicit written consent.

12. Copyright, Trademarks, and Intellectual Property Rights

At EazyCourses, we hold utmost regard for intellectual property, both ours and that of others. If you believe that your intellectual property rights, including copyrights and trademarks, have been infringed upon through the use of our platform, kindly reach out to us at legal@EazyCourses.com. Provide comprehensive details as outlined in our Takedown Policy. Should EazyCourses become aware of, or have reasonable grounds to suspect, that any User-generated Content on the Platform violates our intellectual property rights or those of fellow Users, we retain the authority to take down such content in accordance with the procedures detailed in our Takedown Policy.

13. Disputes Involving User-generated Content

EazyCourses neither oversees nor exercises control over, nor does it guarantee or endorse the accuracy, entirety, or usefulness of any User-generated Content contributed by its Users on the Platform. EazyCourses assumes no obligation to scrutinize modifications or updates to, or the quality, substance, policies, essence, or credibility of such User-generated Content. EazyCourses explicitly disclaims all accountability and accountability for any trust placed on these materials by you. The contents, viewpoints, and insights articulated in these materials, including articles and responses to queries and other content, except for EazyCourses Content, are solely the accountability of the User who has provided them.

14. EazyCourses’s Reserved Rights

Regarding the entire Platform, EazyCourses holds the following rights:

• EazyCourses retains the right to suspend, reject, or terminate your registration on the Platform if necessary to comply with legal and regulatory requirements.
• EazyCourses can remove you and/or your User-generated Content without prior notice if you breach any provisions of the Platform Terms.
• EazyCourses may alter, terminate, or decline to provide Services at its discretion and for any reason, without prior notice.
• Despite any contrary statements in the Platform Terms, EazyCourses can, at its sole discretion, expel any individual from the Platform at any time and for any reason.
• EazyCourses reserves the right to access your account and/or User-generated Content to address technical support inquiries, ensure Platform safety, fulfil legal requirements, and for other legitimate business purposes, as deemed necessary by EazyCourses.
• EazyCourses is not obligated to monitor Platform content or review user interactions, but if EazyCourses becomes aware of any Platform Terms violation or receives notice thereof, it reserves the right to deny access to the Platform, terminate accounts, or remove violating content without prior notice.

15. Availability of the Platform

There may be instances when your access to the Platform is temporarily suspended or limited to accommodate repairs, maintenance, or the introduction of new features or services. Such occurrences might happen without prior notice. We will strive to minimize the frequency and duration of these interruptions.

Please acknowledge that EazyCourses will not be held responsible for any potential losses you might experience if, for any reason, the entire or partial Platform becomes inaccessible at any point in time or for any duration of use.

16. Account Deletion

If you’re a Learner, you have the option to delete your account whenever you wish. This can be done by either sending an email to the address provided under the ‘Contact for User Support/Queries’ section below, or by utilizing the delete option available within your Platform account (if provided). Once your account is deleted, you will lose access to the Platform and any User-generated Content you’ve posted might no longer be accessible. It’s important to note that account deletions are irreversible.

EazyCourses cannot be held accountable for any loss of information or User-generated Content that occurs upon deletion. EazyCourses is not liable for any issues arising from the inability to access User-generated Content post-deletion. Please remember that your account will remain active unless you explicitly request its deletion. Subscription payments will continue as per the terms outlined in the ‘Pricing and Payments’ section until you cancel them or your account is deleted as per your request or in accordance with the Platform Terms.

Kindly note that while we may not be able to delete all communications, photos, files, or publicly available documents you’ve shared on the Platform, we will anonymize your Personal Information (as defined in the Privacy Policy) so that you can no longer be identified as an individual associated with that information on the Platform. We uphold your privacy and will never disclose aggregated or de-identified information in a manner that could identify you as an individual.

For Content Providers, access and usage of the Platform may be governed by a separate agreement with EazyCourses, in addition to the Terms and Conditions and other Platform Terms.

17. Disclaimer:

Platform Usage Disclaimer

By using the platform, its content, and all associated materials, you acknowledge that they are provided on an “as is” and “as available” basis, and your utilization of the platform is solely at your own risk. EazyCourses, its officers, directors, employees, and agents disclaim and exclude all warranties, both express and implied, pertaining to the platform and its use. To the fullest extent permissible by law, EazyCourses disclaims all warranties, conditions, terms, or representations regarding the accuracy, security, reliability, quality, availability, or completeness of the platform, user-generated content on the platform, or any linked sites. EazyCourses assumes no liability or responsibility for various matters, including but not limited to:

1. Errors, mistakes, or inaccuracies within user-generated content or any content on the platform.
2. Personal injury or property damage resulting from accessing and using the platform.
3. Unauthorized access to or use of secure servers containing personal or financial information.
4. Interruption or cessation of transmission to or from the platform.
5. Transmission of bugs, viruses, trojan horses, or similar issues via third parties.
6. Errors or omissions in user-generated content or any other content, and any loss or damage resulting from the use of such content.

EazyCourses functions as an intermediary as defined under the Information Technology Act, 2000. Therefore, it does not provide warranties, endorsements, guarantees, or assume responsibility for any user-generated content, third-party platform, or services advertised through the platform. EazyCourses is not involved in or responsible for monitoring transactions between you and third-party providers of user-generated content or services. Similar to making any service purchase in any environment, it’s advisable to exercise caution and your best judgment.

Please take note of this disclaimer and make informed decisions when engaging with the platform and its content.

18. Limitation of Liability

To the maximum extent permissible by applicable law, EazyCourses, its affiliates, their respective officers, directors, employees, or agents shall not be liable to you for any direct, indirect, incidental, special, punitive, losses, expenses, or consequential damages arising from various situations, including but not limited to:

1. Errors, mistakes, or inaccuracies in user-generated content or any other content available on EazyCourses.
2. Personal injury or property damage resulting from your access to and use of EazyCourses platforms.
3. Unauthorized access to or use of secure servers containing personal or financial information.
4. Interruption or cessation of transmission to or from the EazyCourses platform.
5. Transmission of bugs, viruses, trojan horses, or similar issues by third parties through the EazyCourses platform.
6. Errors or omissions in user-generated content or any other content, resulting in loss or damage incurred from using posted, emailed, transmitted, or available content on the EazyCourses platform.

This applies whether the claims arise from warranty, contract, tort, or any other legal theory, even if EazyCourses has been advised of the possibility of such damages. If your jurisdiction recognizes warranties, disclaimers, and conditions that cannot be legally excluded, EazyCourses and its affiliates limit their liability for claims under those warranties or conditions to re-supplying the EazyCourses platform.

You explicitly acknowledge that EazyCourses is not liable for user-generated content or the defamatory, offensive, or illegal conduct of any third party, and you assume full responsibility for any resulting harm or damage.

The EazyCourses platform is managed and offered by EazyCourses and/or its affiliates, depending on your jurisdiction. EazyCourses does not guarantee that the platform is appropriate or available for use in other locations. Users who access or use the platform from other jurisdictions do so voluntarily and must adhere to local laws.

Please note that this limitation of liability is subject to the laws applicable in your jurisdiction.

19. Indemnity and Release

Subject to the extent allowed by applicable law, you agree to defend, indemnify, and hold harmless EazyCourses, its affiliates, their respective officers, directors, employees, and agents from any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including attorney’s fees) arising from the following situations:

1. Your use of and access to the EazyCourses Platform.
2. Your violation of any term outlined in the Platform Terms.
3. Your infringement upon any third-party rights, including but not limited to copyrights, property rights, or privacy rights.
4. Claims that your User-generated Content resulted in damage to a third party.
5. Violation of any applicable laws.

This responsibility to defend and indemnify will continue even after these Terms and Conditions cease and throughout your use of the EazyCourses Platform.

Furthermore, you explicitly release EazyCourses, its affiliates, and their respective officers, directors, employees, and agents from any costs, damages, liabilities, or other consequences arising from the actions or inactions of third-party vendors or service providers. You specifically waive any claims or demands you may have against EazyCourses, its affiliates, and their respective officers, directors, employees, and agents, whether under statute, contract, or other circumstances, related to such third-party actions or inactions.

20. General Provisions:

a. Legal Notices: If any disputes or claims arise from the use of the EazyCourses Platform, please reach out to us at legal@EazyCourses.com.

b. Modification, Amendment, or Termination: EazyCourses reserves the right, at its sole discretion, to modify or amend the Agreement and policies at any time. By continuing to use the Platform after any modification, you agree to be bound by the updated terms. The Agreement’s modifications shall not confer third-party rights or benefits. We recommend checking the Platform regularly to stay informed about recent changes and updates.

c. Force Majeure: EazyCourses shall not be held liable for failing to perform or delaying the performance of its obligations due to events substantially beyond its control. Such events may include acts of God, governmental actions, war, terrorism, natural disasters, strikes, epidemics, civil unrest, power outages, and severe weather conditions.

d. Miscellaneous: Should any part of the Agreement be deemed unlawful, void, or unenforceable, that portion will be treated as separable and will not impact the validity and enforceability of the remaining provisions. Any notice required for the Platform must be in writing and sent to EazyCourses’ registered office. Continuous, uninterrupted, or secure access to the Platform cannot be guaranteed, as external factors beyond our control may   interfere with its operation. Section headings are for reference purposes only and do not define, limit, construe, or describe the scope of the respective sections. Our failure to act regarding any breach, whether by you or others, does not waive our right to address subsequent or similar breaches.
